Back Matter
Preface
This volume presents the Period Dictionary for The Architecture of Peace treaty commentary series. It contains thirty-two canonical definitions governing interpretation of the 1836 Treaty of Peace and Friendship between the Empire of Morocco and the United States of America.
Purpose The Period Dictionary serves as the authoritative lexicon for all volumes in the Architecture series. Each term is anchored exclusively in period authorities predating or contemporaneous with the 1836 treaty: Blackstone’s Commentaries on the Laws of England (1765–1769), Vattel’s Law of Nations (Chitty trans., 1834), Kent’s Commentaries on American Law (1826–1830), and Wheaton’s Elements of International Law (1836).
Governing Principles The following principles govern all entries: 1. No Modernization — No term may be interpreted through post-1836 legal doctrine, international conventions, or contemporary usage. 2. No Proceduralization — This dictionary classifies legal meanings; it does not instruct enforcement or procedure. 3. No Enforcement Mechanics — The dictionary describes what exists under the treaty; it does not prescribe remedies or steps. 4. Treaty-Faithful — Each term reflects the juridical meaning operative at the treaty’s formation. 5. Immutability — Once frozen, entries may not be modified, summarized, reorganized, or reinterpreted.
Entry Structure Each canonical entry follows a ten-section format:
Architecture of Peace — Volume D
1. Term (verbatim treaty spelling) 2. Treaty location(s) 3. Period function 4. Tier-1 controlling meaning (≤1836 authorities) 5. Consolidated 1836 meaning 6. Structural role in treaty architecture 7. Architecture mapping (three-gateway compliance) 8. Explicit exclusions 9. Plain-language connector 10. Lock statement

CHAPTER 1
Cluster I: Entitlement (Article 24)
This cluster contains five terms governing the Article 24 entitlement structure: GRANTED, ENTITLED, PRIVILEGES, LIBERTIES, and INDULGENCES. 1.0.1 GRANTED 1) Term (verbatim treaty spelling) Granted 2) Treaty location(s) Article 24 — “… entitled to the same privileges, liberties, and indulgences which have been granted to the most favored nation…” 3) Period function Public-law / sovereign-act term (constitutive; not discretionary) 4) Tier-1 — Controlling meaning (authoritative ≤1836) In period public law, “granted” denotes a completed juridical act of sovereign will that vests immediately upon issuance. A grant is not a promise, favor, or policy choice; it is an act that transfers right or status from the sovereign to the beneficiary and cannot be altered by subordinate authorities once perfected. • Blackstone treats a grant as a perfected act whereby the sovereign’s will passes a right that stands unless lawfully resumed by the same sovereign authority that issued it. • Vattel explains that when a sovereign grants a right by treaty, it becomes binding and vested upon entry into force; later domestic measures cannot derogate from the grant without breach.
Architecture of Peace — Volume D
• Kent affirms that treaty grants, once in force, are obligatory and not subject to alteration by municipal acts. • Wheaton confirms that treaty stipulations operate as present engagements upon ratification and bind the parties as law between them. (Chicago Notes & Bibliography: Blackstone, Commentaries; Vattel, Law of Nations; Kent, Commentaries on American Law; Wheaton, Elements of International Law.) 5) Consolidated 1836 meaning (locked) GRANTED — A completed sovereign act that transfers rights immediately upon issuance; what is granted vests at once and cannot be revoked or conditioned by subordinate authority without breach. 6) Structural role in treaty architecture • Constitutive Function: Creates entitlements as part of peace itself. • Vesting Moment: Rights vest upon treaty entry into force, not upon later recognition. • Non-Revocability: Subordinate authorities cannot modify or condition grants. • Article 24 Nexus: What is granted becomes removed from later reclassification. 7) Architecture mapping • Nationality gateway: Yes — grants vest status-linked rights in treaty subjects. • Public record gateway: Yes — the grant’s existence and scope are evidenced on the treaty record; later records may evidence breach only. • Consular venue gateway: Yes — where applicable, grants allocate venue consequences exclusively as stipulated. • Article 24 entitlement logic: Direct — what is granted becomes part of peace itself and is removed from later reclassification. 8) Explicit exclusions (locked) × No treating “granted” as policy-based or revocable. × No conditioning effect on recognition, administrative approval, or reissuance. × No recasting a grant as an equitable indulgence or temporary allowance. × No substituting domestic statutes or procedures to modify a treaty grant. 9) Plain-language connector
The Period Dictionary
In other words: when the treaty says something is granted, it means the sovereign has already given it for good—it takes effect immediately and no later office can change it. 10) Lock statement LOCK: This term may not be modernized or softened in later volumes. Entry status: CANONICAL · LOCKED · QA-PASSED (10/10) 1.0.2 ENTITLED (ENTITLEMENT) 1) Term (verbatim treaty spelling) Entitled 2) Treaty location(s) Article 24 — “The United States shall be entitled to the same privileges, liberties, and indulgences…” 3) Period function Public-law / status term (vested legal right; not discretionary benefit) 4) Tier-1 — Controlling meaning (authoritative ≤1836) In period public law, “entitled” describes a juridical status whereby the beneficiary holds a vested legal right enforceable as a matter of law, not as a favor or discretionary benefit. To be entitled is to possess a legal claim that must be honored by the obligated party. • Blackstone defines entitlement as the possession of a legal right that cannot be withheld without injury; it is a status, not a request. • Vattel confirms that treaty entitlements vest upon the treaty’s entry into force and bind the parties to performance without further condition. • Kent affirms that entitlements under treaty law operate as vested rights that municipal authorities cannot deny or condition. • Wheaton explains that entitlement under international agreement creates obligations that the parties must perform in good faith. (Chicago Notes & Bibliography: Blackstone, Commentaries; Vattel, Law of Nations; Kent, Commentaries on American Law; Wheaton, Elements of International Law.) 5) Consolidated 1836 meaning (locked)
Architecture of Peace — Volume D
ENTITLED (ENTITLEMENT) — A vested legal status conferring rights that must be honored as a matter of law; entitlement is not a request, application, or subject of discretion, but a juridical position that commands performance. 6) Structural role in treaty architecture • Status Function: Establishes legal position of treaty beneficiaries. • Performance Obligation: Creates binding duty on the obligated party. • Non-Discretionary: Cannot be conditioned on policy, approval, or reissuance. • Article 24 Foundation: The word “entitled” makes Article 24 provisions vested rights, not requests.
